1. Agreement and Scope
These Terms of Service ("Terms") govern your access to and use of Brewstead, including the Brewstead application, website, account services, cloud features, and any related services that expressly incorporate these Terms. These Terms are between you and the current operator of Brewstead. Brewstead is presently operated from Texas, United States. References to "Brewstead," "we," "us," or "our" mean the current operator of the Brewstead service.
By expressly accepting these Terms, creating or linking a Brewstead account, purchasing Brewstead Early Access Pro, or using Brewstead after an acceptance screen is presented, you agree to these Terms. If you do not agree, do not use the service.
Brewstead V0.1 Early Access is currently intended for users in the United States. Future geographic availability may differ.
2. Eligibility and Lawful Use
You must be at least 21 years old to use Brewstead. Brewstead does not authorize anyone to produce, possess, sell, transport, serve, or consume alcoholic beverages in violation of law. You are responsible for determining and following all federal, state, local, licensing, tax, and other legal requirements that apply to you.
Brewstead may be used for lawful personal, home, educational, or commercial brewing and fermentation activities. Commercial users remain solely responsible for permits, licenses, production records, taxes, labeling, inspections, regulatory approvals, and other compliance obligations. Brewstead is not a commercial regulatory-compliance system.
3. Accounts, Anonymous Use, and Authentication
Brewstead may allow some Free features to be used anonymously. Anonymous use may still rely on an anonymous service identifier for cloud sync or security. An anonymous identity is not the same as a recoverable registered account, and recovery may be impossible if the device or anonymous credentials are lost.
Registered accounts use a verified email address. Brewstead Early Access Pro requires a verified registered account before Pro access is activated. You are responsible for maintaining access to the email associated with your account and for keeping your account secure.
Your paid entitlement is associated with your Brewstead account identity, not merely the spelling of your email address. Brewstead may provide a verified process to update an account email or other profile details without requiring a new account. Account, Pro, and Founding Brewer rights may not be sold or transferred to another person without Brewstead permission.
4. Brewstead Early Access and Paid Features
Brewstead V0.1 may be offered as an Early Access release. The specific paid offer, price, included scope, refund rights, and entitlement duration are governed by the Brewstead Early Access Pro Purchase Terms and Refund Policy in effect at the time of purchase. Those documents are incorporated into these Terms for paid Early Access purchases.
Early Access software may be incomplete, contain bugs, change over time, or become temporarily unavailable. Brewstead may add, modify, postpone, remove, or temporarily disable features for development, security, legal, safety, reliability, or operational reasons. Planned or previewed V1 features are not promised as Early Access features unless expressly stated in the purchase offer.
5. User Content and Ownership
You retain ownership of original recipes, recipe directions, notes, photos, videos, and other original content you create and submit to Brewstead ("User Content"). You grant Brewstead a limited, non-exclusive license to host, store, copy, process, transmit, display, and otherwise use User Content only as reasonably necessary to operate, secure, support, improve, and provide the service, comply with law, or carry out actions you request.
You are responsible for ensuring that you have the right to upload, import, store, or share content that you did not create. You may not use Brewstead to infringe copyright, trademark, privacy, publicity, or other rights of another person.
You may use, export, and share your resulting recipes and brewing records. Brewstead retains ownership of the Brewstead software, interface, artwork, written guidance, built-in catalogs, proprietary datasets, calculation methods, scoring and recommendation systems, yeast-health or suitability logic, fermentation decision systems, and other Brewstead materials and methods to the extent protectable by law.
6. Sharing Features
If Brewstead enables recipe or brew sharing, a user may intentionally create a link-accessible snapshot. Anyone who has an active share link may be able to view the shared snapshot. Shared content is not intended to be publicly searchable unless Brewstead later introduces and clearly identifies a public discovery feature.
A shared snapshot does not automatically update when the private source recipe changes. The owner may revoke or disable a share link. Account email, transaction information, device information, private logs, and other non-public account metadata are not part of a public share unless Brewstead later provides a specific, clearly disclosed feature for that data.
If public usernames are introduced, sharing may require a unique public username. Brewstead may reserve or reject usernames that impersonate others, imply official Brewstead status, are obscene or abusive, or infringe rights. Brewstead may impose reasonable username-change limits, including a 90-day cooldown. Sharing does not transfer ownership of the content to Brewstead or to viewers.
7. Feedback
You may send bugs, suggestions, or product feedback to homebrewingapp@gmail.com. You retain ownership of any original copyrighted material you submit, but you grant Brewstead permission to use ideas, suggestions, and feedback to develop or improve Brewstead without payment, royalty, or obligation to implement the suggestion.
8. Prohibited Conduct
You may not misuse Brewstead. Prohibited conduct includes, without limitation:
- using Brewstead for unlawful activity, credible threats, fraud, trafficking, exploitation, or other serious abuse;
- uploading malware, malicious code, harmful tracking payloads, or content intended to compromise users or Brewstead systems;
- creating accounts in bulk, using bots or scripts to abuse APIs, bypassing rate limits, or intentionally overloading the service;
- attempting to bypass authentication, security rules, payment verification, Pro entitlements, bans, access controls, or other safeguards;
- using cracked, modified, or repackaged builds to obtain unauthorized access or paid functionality;
- unauthorized reverse engineering, decompilation, extraction, reproduction, or cloning of Brewstead source code, proprietary algorithms, recommendation systems, catalogs, databases, or datasets, except to the extent applicable law expressly prevents this restriction;
- automated scraping, harvesting, or bulk extraction of Brewstead catalogs, guidance, scoring outputs, or proprietary data;
- copying, reselling, sublicensing, redistributing, or presenting Brewstead itself as your own software or service without authorization; or
- impersonating Brewstead personnel or another person, or knowingly submitting false abuse, intellectual-property, or security reports.
Good-faith security testing is allowed only when Brewstead has expressly authorized the testing. Brewstead may later publish a responsible security-reporting policy or authorized testing program.
9. Brewing Guidance, Calculations, and Safety
Brewstead provides informational brewing and fermentation tools, calculations, estimates, and decision support. It does not replace your judgment or qualified professional advice. Brewstead guidance may be informed by manufacturer-published specifications, technical references, and other research where available, but manufacturers may change products or instructions and Brewstead may not immediately reflect every change.
Estimated alcohol content, gravity, nutrient needs, pH guidance, fermentation projections, timing windows, yeast suitability, and similar outputs depend on user inputs, ingredient assumptions, measurement tools, environmental conditions, biological variability, and other factors. Brewstead does not guarantee a particular brewing result.
You are responsible for the accuracy of measurements you enter and for independently determining whether fermentation is complete and whether a beverage is safe to transfer, stabilize, package, bottle, keg, transport, serve, or consume. An app stage recommendation, forecast, timer, or stable-reading indication is not a guarantee that fermentation has stopped or that packaging pressure is safe.
If Brewstead presents a safety warning and you choose to override or ignore it, you accept responsibility for that decision. Always follow current manufacturer labels and instructions for nutrients, acids, sulfites, sorbate, finings, sanitizers, chemicals, ingredients, and equipment. Brewstead does not determine whether a recipe is allergen-free.

10. Service Availability, Offline Use, and Updates
Brewstead does not guarantee uninterrupted, continuous, or error-free availability. Maintenance, cloud-provider outages, security incidents, updates, legal requirements, and circumstances outside Brewstead control may cause temporary interruptions or feature restrictions.
Many core functions may be designed to work locally or offline, but authentication, cloud sync, purchase verification, sharing, updates, and other network-dependent features require internet access. Previously verified Pro access may be subject to a limited offline grace period under the applicable purchase terms.
Brewstead may require an update when an older version is insecure, incompatible with the backend, or no longer reasonably supportable. Supported devices and minimum operating-system versions may change over time. You should maintain your own exports or copies of especially important records because no storage or backup system is infallible.
11. Third-Party Services, Links, and Recommendations
Brewstead may rely on third-party service providers for hosting, authentication, analytics, crash reporting, payments, email, storage, or other functions. Brewstead may also link to third-party manufacturer documentation, educational resources, videos, or products. Brewstead does not control and does not guarantee third-party sites, products, services, availability, instructions, or privacy practices.
A Brewstead recommendation does not by itself mean Brewstead is sponsored by, affiliated with, or compensated by the manufacturer or seller. If Brewstead later uses affiliate or compensated links, Brewstead will disclose that relationship where appropriate.
12. Enforcement, Suspension, and Termination
Brewstead may use reasonable technical measures to protect the service, including rate limiting, blocking abusive requests, revoking sessions, disabling public shares, restricting purchases, or suspending accounts. For ordinary violations, Brewstead may warn a user. If a user has received a warning within the preceding six months, Brewstead may terminate the account for a subsequent violation.
Brewstead may take immediate action without prior warning when conduct is sufficiently severe, including suspected fraud, deliberate Pro circumvention, security attacks, malware, credible threats, human exploitation or trafficking, or other serious unlawful or abusive activity. Serious abuse may result in permanent ineligibility for Pro or future paid access. Brewstead may preserve evidence or report suspected unlawful conduct to appropriate authorities when permitted or required by law.
If Brewstead terminates an account because of a material Terms violation, paid access may be lost without refund except where applicable law requires otherwise. A termination made through no fault of the user may be handled differently, including an appropriate refund where warranted.
13. Privacy and Private-Content Review
The Brewstead Privacy Policy explains how Brewstead handles personal information. Brewstead does not undertake a duty to proactively monitor every private recipe, image, share, or user activity. Brewstead does not routinely browse private user content, but may conduct targeted review when there is a legitimate, documented safety, security, support, fraud, abuse, legal, or operational reason.
14. Warranties and Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, BREWSTEAD AND ITS SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." BREWSTEAD DISCLAIMS WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE, DATA, CALCULATIONS, GUIDANCE, SYNC, OR RESULTS WILL BE ERROR-FREE OR UNINTERRUPTED. Some jurisdictions do not allow certain disclaimers, so some of these exclusions may not apply to you.
15. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, BREWSTEAD WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, BUSINESS INTERRUPTION, PERSONAL OR PROPERTY LOSS ARISING FROM RELIANCE ON BREWING ESTIMATES, OR SIMILAR LOSSES, EVEN IF BREWSTEAD HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, BREWSTEAD'S TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO BREWSTEAD FOR THE SERVICE GIVING RISE TO THE CLAIM DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY. This limitation does not apply where applicable law prohibits the limitation or exclusion of liability.
16. Changes to Brewstead or These Terms
Brewstead will evolve. We may update these Terms and related policies. We will provide reasonable notice of material changes where appropriate, and we may require affirmative acceptance of a new version before continued access to certain account or online functionality. Changes do not retroactively erase rights or obligations that applicable law does not permit us to change.
17. Assignment, Ownership Changes, and Successors
Brewstead may assign or transfer these Terms, customer relationships, and related rights and obligations in connection with formation of a business entity, restructuring, merger, acquisition, sale, or lawful succession. A change in ownership does not by itself eliminate accrued customer rights or existing paid entitlements. A successor may update future terms in accordance with the change process above and applicable law.
Users may not assign or transfer their Brewstead accounts, paid entitlements, or Founding Brewer status without Brewstead permission.
18. Governing Law
To the extent permitted by law, these Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Mandatory consumer protections or other rights that cannot lawfully be waived remain in effect.
19. General Terms
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Brewstead's failure to enforce a provision on one occasion is not a waiver of the right to enforce it later. These Terms, together with the Privacy Policy, applicable purchase terms, refund policy, safety disclaimer, and other policies expressly incorporated into them, form the agreement governing the service. Events reasonably outside Brewstead control may excuse or delay performance to the extent permitted by law.
Provisions that by their nature should survive account closure or termination - including ownership and intellectual-property protections, completed-payment obligations, fraud and security provisions, warranty and liability provisions, and other logically continuing terms - survive to the extent permitted by law.
